GENERAL
TERMS AND
CONDITIONS.

1.1 These general terms and conditions govern all business relationships between Rocket Games AG (hereinafter ‘Rocket Games’) and its customers.

1.2 The offer is exclusively directed at:

• natural persons aged 18 or over with full legal capacity
• customers resident in Switzerland, the Principality of Liechtenstein or the European Union (EU)

1.3 Deviating customer terms are not recognised.

2.1 Products and prices shown in the online shop do not constitute a binding offer.

2.2 A purchase contract arises only upon shipping confirmation or confirmation that goods are ready for collection.

2.3 Rocket Games reserves the right to reject orders without giving reasons or cancel them if unavailable.

3.1 Orders are placed through the online shop or physical sales outlets.

3.2 If an item is unavailable, the order is cancelled. No entitlement to damages exists.

4.1 Delivery area: Deliveries are made to Switzerland, the EU and Liechtenstein.

4.2 Shipping: Carriers include DHL, UPS, DPD or Swiss Post. There is no entitlement to a particular carrier.

4.3 Delivery times: Delivery times are non-binding. For delays exceeding 14 days, the customer may withdraw after written notice.

4.4 Transfer of risk:

• EU consumers: risk remains with Rocket Games until handover
• outside the EU or when independently commissioning transport: risk transfers on dispatch

4.5 Partial deliveries are permitted.

4.6 Collection: Rocket Games offers collection.

5.1 The price at the time of ordering applies.

5.2 Prices include statutory VAT (CH/EU), where applicable.

5.3 Additional costs such as shipping, fees or duties are shown separately.

5.4 Deliveries outside the EU may incur customs duties or taxes payable by the customer.

5.5 Errors and price changes are reserved.

6.1 Available payment methods are shown in the shop.

6.2 Rocket Games may restrict payment methods and perform credit checks.

6.3 For prepayment, shipping occurs only after payment is received.

6.4 Late payment incurs a CHF 20 reminder fee from the second reminder. Debt collection referral is possible.

6.5 Retention of title: Goods remain Rocket Games’ property until paid in full.

7.1 Consumers have a 14-day withdrawal right from receipt.

7.2 Registration through the service portal is required.

7.3 The customer initially bears return shipping costs.

7.4 Costs are reimbursed for justified complaints.

7.5 Personalised products and individually configured controllers have no withdrawal right.

8.1 Returns must be complete, in original packaging and used only for inspection.

8.2 The tracking number must be reported within 3 days after return.

8.3 Compensation for use:

• New → 0%
• Light use → 15%
• Visible use → 35%
• Heavy use → 60%
• Unsaleable → 100%

9.1 Statutory warranty: 2 years.

9.2 The warranty covers repair or replacement.

9.3 Normal wear, mechanical damage, liquid damage and improper use are excluded.

9.4 Repairs must be registered through the service portal.

9.5 Shipping to the service centre is at the customer's expense.

10.1 No right of withdrawal for personalised products.

10.2 Warranty:

• 2 years on modifications
• 90 days on original sticks
• 2 years on Hall Effect sticks

10.3 Warranty exclusions apply to wear, incorrect use and interventions or modifications.

11.1 General: Rocket Games allows used controllers to be sent in for credit against an order. Stated trade-in values are non-binding estimates.

11.2 Requirements: The customer confirms lawful ownership, no third-party rights and that the goods are not stolen. Rocket Games may check serial numbers and reject devices.

11.3 Shipping obligation: The controller must be sent in within 14 calendar days. Receipt of the goods is decisive.

11.4 Missed deadline: If received late, Rocket Games may cancel the order or remove the trade-in value.

11.5 Shipping risk: Shipping is at the customer's risk.

11.6 Valuation: The final valuation takes place after inspection. Discrepancies lead to an adjustment or rejection.

11.7 Rejection: If rejected, return shipping is at the customer's expense, or the customer waives the return. Disposal is possible after 7 days without a response.

11.8 Credit: No cash payment – credit only.

11.9 Ownership: Ownership transfers to Rocket Games after acceptance.

11.10 Misuse: Fraud or false information may result in cancellation and exclusion from the service.

12.1 Liability applies only in cases of intent or gross negligence.

12.2 No liability for delivery delays caused by carriers, indirect damages, wear or improper use.

13.1 Data is processed in accordance with the GDPR and the Swiss Data Protection Act.

13.2 Customers have rights to access, rectification and deletion.

14.1 Swiss law applies.

14.2 The place of jurisdiction is Rümlang or the customer's place of residence.

14.3 Rocket Games reserves the right to amend the terms and conditions.
